PETITION STATEMENT 9-1-2010 LMS

On September 1st during a meeting of the Salmon City Council Mayor John Miller read a portion of a letter written by former City Police Chief Jim Spain to Lemhi County Sheriff Lynn Bowerman.

The letter was written in reference to a statement appearing on the recall petition against Miller which alludes to the mayor’s, “….instructing the Salmon Police Chief, Jim Spain, to not enforce the Drunk Driving laws of the State of Idaho, thus endangering the citizens of Salmon that elected him to the position of Mayor.”

Miller quoted the letter from Spain to Bowerman in which Spain wrote, “I was contacted by yourself [Sheriff Bowerman] on August 4, 2010 and advised that John Miller had filed a complaint with your office in regards to an untruthful statement of fact appearing on the current recall petition for him in Salmon and initiated by Susan Schaffner.”

The letter went on to say Sheriff Bowerman had informed Spain that the Lemhi County Prosecutor wanted Spain to submit a statement regarding any knowledge pertaining to the statement on the petition.

In answer to the prosecutor’s request Spain first clarified he had not seen a copy of the petition at that point. He indicated he then verified what was printed on the recall form by reading one of the petitions being circulated. Spain then made the following statement. “While Chief of Police of the Salmon Police Department, John Miller did not ever give a blanket, direct order to not arrest “any” DUI drivers in our jurisdiction.”

After reading the letter to the council Miller told council members he hopes the statement by Spain will put the matter to rest. He said, “I hope we can put this baby to bed. I’ve kept saying I never said that…I’d never given instructions to say that. We need this to go away. We’re kind of being the laughing stock of Idaho.” Miller closed the subject by saying, “Let’s put this behind us.”
