EXTENSION APPROVED 11-7-12 LMS
The Salmon City Council has approved a requested one year extension on construction of the Mountain Valley Endeavors housing development known as “The Bluffs.”
Part of the original agreement between the city and the company was that up to three one year extensions would be possible if construction was delayed due to circumstances beyond the company’s control. Another reason for possible revocation of the agreement was if the company’s structure changed from what it was at the time the development was approved. The company’s reason given for past extensions was the unexpected national economic downturn. What the council passed on a five to one vote will be the third and final extension.
The council granted the extension at its November 7 meeting after verifying with the Idaho Secretary of State that Mountain Valley Endeavors LLC is still a viable company. It was confirmed by City Attorney Fred Snook that in order for the city to withdraw from the agreement there would have to be very sound and well documented reason to do so. Questions have been raised concerning an increase of traffic in the South St. Charles area proposed for the development since the time of the agreement. Snook said traffic issues were addressed and approved in the original decision and can’t be re-judged at this point without the potential of inviting litigation.
The original agreement between the city and Mountain Valley Endeavors was entered into four years ago. Council President Jim Baker commented that the current situation indicates a need to look more critically at any future agreements that would extend for this length of time.
Those voting in favor of the extension were Jim Bockelman, Jesse Bender, Jim Baker, Fred Waidely and Ken Hill. Jim Kluesner cast the opposing vote.
