QUORUM DILEMMA DECIDED 2-3-16 LMS

The Salmon City Council is comprised of six members. When four of those members are together it constitutes a Quorum and therefore becomes an official meeting which by law requires an agenda and prior notice.

On February 25 a pre-permitting meeting is scheduled with the several agencies that will be deciding on whether or not to issue permits for the proposed Salmon Whitewater Kayak Park and four council members will be attending. The question that arose during the February 3 Salmon City Council meeting was just how to go about the quorum issue since it is not an official meeting of the council and yet a majority of the councilís six members will be in attendance.

After checking with legal experts it was decided if four out of six of the council members attend it will be construed as a regular City Council meeting therefore the city will have to pre-advertise it, just as it does for a regular council meeting, and notes of the meeting will have to be taken. In effect there will be a Salmon City Council meeting within a public meeting.

At its next meeting the council will further discuss what the city wants to present, if anything, and whether there will be one spokesperson or individual participation. In the meantime Whitewater Park spokesperson Breanne Green will be contacted for more information as to what input is wanted from the city.

The Pre-permitting Meeting of agencies is open to the public and will be held at the Fish and Game Office Thursday, February 25 from noon to 3:30PM.

On another technicality, the council has received an alley vacation request from Steele Memorial Hospital. According to City Clerk Mary Benton a vacation process requires a notice be sent to all neighboring properties within 300 feet of the requested vacation and a notice of a Public Hearing has to be published twice in the newspaper.

The date for the alley vacation Public Hearing was set for March 2 at 6:15 PM during the councilís regular meeting.
