FINDINGS OF FACT 5-22-17 LMS

Decisions on two subjects of Public Hearings that were held April 24 were announced at the May 22 meeting of the Lemhi County Commissioners.

The first decision came after a work session was held in which County Attorney Bruce Withers summarized his findings and conclusions after review of a vacation request pertaining to the Deer Creek Subdivision. He said he had reviewed all the application paperwork as well as the testimonies presented at the April hearing and that everything is in order. He went on to recommend conditions that should be included in accepting the proposed vacation.

The first condition he submitted to the board was that a depiction of the road which runs through the subdivision be made. Withers also said a specific instrument must be executed that dedicates a public right-of-way through the subdivision.

The commissioners moved and seconded a motion to approve the proposed vacation of the Deer Creek Valley Subdivision along with the recommended conditions. It passed unanimously.

The subdivision is located south of Salmon on the west side of the Salmon River and was created in 1973 on a 198 acre parcel of land. There have been no improvements or lot sales since that time. It is owned by the Salmon River Properties Inc. estate.

The second topic of decision involved repealing Ordinance 2012-1 and replacing it with Ordinance 2017-1. City/County Building Administrator Gary Goodman explained that the new ordinance is an update of the Lemhi County Development Code which was found to have duplications in its text. He said the new document is a reformatting of the old one and has a few changes that were made to keep up with current state legislation. Withers stated the Planning and Zoning Commission has reviewed the document and recommended it be passed.

The commissioners voted unanimously to adopt the new ordinance.
